How to Discuss a Final Will and Testament With Your Parents

There are few things in life as unpleasant as discussing death and dying, and perhaps that is why so few of us take the time to create a last will and testament. The creation of a final will and testament requires family members to come face to face with their own mortality, and this is certainly not something most people want to think about. Even when a family member has experienced a serious health problem there may still be a reluctance to make out a will, but it is important to overcome this initial reluctance in order to create this vital legal document.

One of the touchiest parts of the whole will and testament creation process is prodding a parent to finally create this important document. Broaching this difficult subject is understandably difficult, and as a result many adult children never have this discussion with their parents. Unfortunately the lack of a will can have serious legal and financial implications when a death does occur – complications that could have been avoided with a little time and a little prodding.

A Family Affair

One of the most effective ways for adult children to prod their parents into finally creating a will is to propose the creation of wills as a family affair. In many cases those adult children will have families and children of their own to protect, and they may be able to convince mom and dad to do a will as part of a larger family estate plan.

This tactic helps in two ways. First and foremost it allows the adult children to create a last will and testament of their own, providing their families with the legal and financial protection they so desperately need. In addition this approach takes some of the hesitancy and discomfort out of creating a last will and testament. Instead of focusing on the elderly parent and his or her limited life expectancy the testament is done as part of a larger package. This reduces the anxiety many people feel when thinking about their final testament. After all no one wants to admit that they are going to die, and creating a will forces the individual to confront this difficult reality.

When taking this approach to the creation of a last will and testament it may be helpful to hire a single attorney to do all of the wills for the family. This approach can provide a number of benefits, including reduced costs, reduced time and effort and reduced stress. Since the family is gathered together each family member can find the documents they need and create a last will and testament of their very own.. This group approach can also reduce stress and family tension, since no one member will feel pressured or singled out.

Of course this group approach will not work for every family, and it is important for children to tailor this delicate discussion to the parent’s personality. Some parents will be quite amenable to creating a last will and testament. They may also be very grateful for the offer of help being extended by their children. Other parents will be quite resistant – even angry – that such a sensitive subject is being discussed in a family setting. It is important for each adult child to understand his or her parents in order to find the right approach to this difficult subject.

Many children find comfort by putting off this difficult decision until the time is right, but the hard truth is that there is no one right time to discuss the creation of a last will and testament. There will never be an optimal time to have this vital discussion, so the best strategy is for children to muster the courage they will need and push forward to help their parents protect themselves and their assets.
